Welcome to Plotted Passage.

 

These Terms of Use (“Terms”) govern your access to and use of www.plottedpassage.com, including its pages, blog posts, travel guides, photographs, videos, newsletters, forms, downloadable materials, features, content, and any other services or functionality made available through the website (collectively, the “Site” or “Services”).

For purposes of these Terms, “Plotted Passage,” “we,” “us,” or “our” refers to Plotted Passage and its owners and operators.

The Site is intended for a general audience age 16 and older. By submitting personal information through the Site, including by subscribing to our newsletter or submitting a travel-advising inquiry, you represent that you are at least 16 years old.

If you enter into a binding agreement with Plotted Passage for travel-advising services, you also represent that you have the legal capacity to enter into that agreement or are otherwise legally authorized to do so.

2. Acceptance of These Terms

 

These Terms govern your use of and access to the Site and Services. By accessing, browsing, visiting, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

 

These Terms apply to all Users of the Site. If you do not agree with these Terms or our Privacy Policy, you should not access or use the Site or Services. Your use of certain services, including personalized travel-advising services, may also be subject to additional agreements, disclosures, terms, or conditions. If additional terms apply to a specific service and conflict with these general Terms, the more specific terms will control with respect to that service.

3. Age Requirement

 

The Site is intended for a general audience age 16 and older and is not directed to children under the age of 16. If you are under 16, please do not submit your name, email address, travel information, or any other personal information through the Site.

 

If we become aware that personal information has been submitted by an individual under 16 without any authorization required by applicable law, we may take reasonable steps to delete that information.

4. Informational Travel Content

 

The Site contains travel guides, itineraries, recommendations, hotel information, restaurant information, destination information, opinions, personal experiences, photographs, videos, and other travel-related content.

 

Blog content is provided for general informational and educational purposes only.

 

Travel information can change frequently. Prices, schedules, operating hours, availability, admission requirements, passport and visa requirements, entry rules, transportation schedules, weather conditions, snow conditions, restaurant operations, hotel amenities, tour availability, local laws, regulations, safety conditions, and other travel information may change after an article is published.

 

Although we make reasonable efforts to provide helpful and accurate information, we do not guarantee that every piece of information on the Site is complete, current, accurate, error-free, or appropriate for your specific circumstances.

You are responsible for independently confirming important information with the applicable hotel, airline, government agency, tour provider, restaurant, attraction, transportation provider, travel supplier, or other official source before making travel decisions.

5. Personal Experiences and Opinions

 

Some content on the Site is based on our personal travel experiences, preferences, and opinions.

 

Travel experiences are subjective. A destination, hotel, restaurant, tour, activity, product, or service that we enjoyed may not be appropriate or enjoyable for every traveler.

 

Statements expressing preferences, recommendations, rankings, comparisons, or opinions reflect our views at the time the content was created and should not be interpreted as guarantees regarding your experience.

6. Travel-Advising Services

 

Plotted Passage may offer personalized travel-advising or travel-planning services separate from the general informational content available on the Site. Travel-advising services are currently offered only to clients located in the United States.

 

Submitting a contact form, completing a travel inquiry, sending us an email, subscribing to our newsletter, or otherwise interacting with the Site does not by itself create a client relationship or obligate Plotted Passage to provide travel-advising services.

 

A travel-advising relationship will arise only when Plotted Passage expressly agrees to provide services and any required engagement, service, payment, or other terms have been completed. Additional agreements, disclosures, terms, conditions, or policies may apply to travel-advising services. If those additional terms conflict with these Terms with respect to a particular travel-advising service, the more specific terms will control.

7. No Guarantee of Travel Availability, Pricing, or Experience

 

Travel inventory and pricing can change at any time.

 

Plotted Passage does not guarantee:

  • availability of any hotel, flight, cruise, tour, restaurant, activity, rental, transportation service, or other travel product;

  • any particular price, rate, fare, discount, promotion, or availability;

  • that a quoted or displayed rate will remain available;

  • any particular weather, snow, ocean, or other environmental conditions;

  • specific room assignments, upgrades, views, amenities, or benefits;

  • airline schedules or flight operations;

  • transportation schedules;

  • entry into any country or destination;

  • approval of a passport, visa, authorization, or other travel document;

  • availability of attractions, restaurants, tours, or activities;

  • the safety or suitability of a particular destination or activity;

  • the quality of services provided by independent third parties; or

  • any specific travel experience or outcome.

 

Travelers are responsible for reviewing and understanding applicable booking terms, cancellation policies, refund policies, documentation requirements, health requirements, supplier terms, and other conditions before booking.

8. Third-Party Travel Providers

 

Plotted Passage does not own or control the airlines, hotels, resorts, tour operators, cruise lines, transportation companies, restaurants, attractions, booking platforms, rental companies, retailers, travel suppliers, or other third parties that may be discussed, recommended, linked, or referenced on the Site.

Those businesses are independent third parties.

Plotted Passage is not responsible for their:

  • acts or omissions;

  • cancellations;

  • delays;

  • schedule changes;

  • service quality;

  • injuries;

  • accidents;

  • losses;

  • closures;

  • bankruptcies;

  • refunds;

  • pricing;

  • availability;

  • representations;

  • privacy practices;

  • security practices; or

  • other conduct.

 

Your purchase, booking, or use of a third party’s products or services is subject to that third party’s own contracts, policies, privacy practices, terms, and conditions.

  • booking terms;

  • cancellation policies; and

Third parties may independently collect personal information from you, use cookies or similar technologies, process payment or booking information, or otherwise collect and use information in accordance with their own policies.

 

Plotted Passage does not control how those third parties collect, use, store, disclose, or protect personal information. We are not responsible for the privacy practices, security practices, content, availability, products, services, representations, or policies of any third-party website or service.

 

Before providing personal information, making a purchase, or completing a booking through a third-party website, you should review that third party’s privacy policy, terms of use, and applicable booking conditions.

 

The inclusion of a link on our Site does not mean that Plotted Passage is responsible for the third party’s data-handling or business practices.

12. No Professional Legal, Medical, Immigration, Financial, or Safety Advice

For official information regarding passports, visas, immigration, entry requirements, travel advisories, local laws, health requirements, or other government matters, consult the appropriate government authority.

 

For medical issues, consult a qualified healthcare professional.

13. Assumption of Travel Risk

 

You understand that travel and recreational activities involve risks that cannot always be predicted, eliminated, or controlled.

 

To the fullest extent permitted by applicable law, you assume responsibility for decisions you make based on general information provided on the Site and for risks associated with your own travel activities.

 

Nothing on the Site should be interpreted as a representation or guarantee that any destination, neighborhood, hotel, activity, excursion, transportation method, ski resort, beach, trail, body of water, restaurant, or other travel experience is completely safe or risk-free.

14. Intellectual Property

 

Unless otherwise stated, the Site and its original content are owned by or licensed to Plotted Passage and are protected by applicable copyright, trademark, and other intellectual-property laws.

Nothing in these Terms transfers ownership of Plotted Passage intellectual property to you.

  • impersonates another person; or

  • is otherwise prohibited by law.

 

Unless we separately agree otherwise, providing feedback or suggestions does not obligate Plotted Passage to use, compensate you for, or implement that feedback.

  • submit fraudulent travel inquiries;

  • engage in unlawful spam or solicitation;

  • interfere with another visitor's use of the Site;

  • falsely represent an affiliation with Plotted Passage; or

  • engage in conduct that could damage Plotted Passage, the Site, or other Users.

 

17. Privacy

 

Your use of the Site is also subject to our Privacy Policy. Our Privacy Policy explains how we collect, use, disclose, and protect personal information and is incorporated into these Terms by reference.

Third-party websites and affiliate partners have their own privacy practices, which are not controlled by Plotted Passage.

18. Website Hosting and Third-Party Technology

 

The Site is currently hosted through Wix. Wix and other technology providers may provide website hosting, analytics, forms, security, infrastructure, and related functionality. Those providers operate under their own terms, privacy practices, and policies.

 

Plotted Passage is responsible for its own Site content and business practices, while third-party platform providers remain responsible for their own services and data practices.

19. Site Availability

 

We may change, suspend, update, remove, or discontinue any portion of the Site at any time.

 

We do not guarantee that:

  • the Site will always be available;

  • the Site will operate without interruption;

  • every link will remain active;

  • every feature will remain available;

  • every article will remain current; or

  • the Site will be free from errors or technical issues.

 

We may update, remove, revise, or correct content at any time without notice.

  • THE AVAILABILITY OR PRICE OF TRAVEL SERVICES;

  • THE QUALITY OR SAFETY OF THIRD-PARTY PRODUCTS OR SERVICES;

  • THE RESULTS OF FOLLOWING ANY TRAVEL ITINERARY, GUIDE, OR RECOMMENDATION;

  • THE SUITABILITY OF ANY DESTINATION, PROPERTY, ACTIVITY, OR SERVICE FOR A PARTICULAR PERSON; OR

  • THE SECURITY OR OPERATION OF THIRD-PARTY WEBSITES.

 

TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

Some jurisdictions do not permit certain warranty exclusions, so some of these limitations may not apply to you.

21. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLOTTED PASSAGE AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • TRAVEL DECISIONS;

  • THIRD-PARTY PRODUCTS OR SERVICES;

  • LOST BOOKINGS;

  • PRICE CHANGES;

  • TRIP INTERRUPTIONS;

  • CANCELLATIONS;

  • DELAYS;

  • INJURY;

  • ILLNESS;

  • LOSS OF PROPERTY;

  • LOSS OF DATA;

  • LOST PROFITS;

  • THIRD-PARTY PRIVACY OR SECURITY PRACTICES; OR

  • OTHER LOSSES ARISING FROM OR RELATED TO USE OF THE SITE.

 

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

22. Indemnification

 

To the extent permitted by applicable law, you agree to indemnify and hold harmless Plotted Passage and its owners, operators, employees, contractors, affiliates, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • your unlawful misuse of the Site;

  • your violation of these Terms;

  • your infringement of another person's rights; or

  • unlawful or unauthorized material you submit through the Site.

 

This provision does not apply to the extent prohibited by applicable consumer-protection law.

23. Geographic Scope of Travel-Advising Services

 

The informational blog may be accessed by visitors located in the United States and internationally. However, personalized travel-advising services offered through Plotted Passage are currently intended only for clients located in the United States unless we expressly state otherwise in writing.

 

Nothing on the Site constitutes an offer to provide personalized travel-advising services in a jurisdiction where doing so would violate applicable law, licensing, registration, or other requirements.

24. International Visitors

 

The Site is operated from the United States. Visitors accessing the Site from outside the United States are responsible for complying with laws applicable in their own jurisdiction. The availability of the informational blog in another country does not necessarily mean that Plotted Passage offers travel-advising services in that country.

25. Changes to These Terms

 

We may update these Terms periodically to reflect changes in:

  • our Site;

  • our services;

  • our business practices;

  • technology;

  • applicable law; or

  • other circumstances.

 

When we update these Terms, we will revise the “Last Updated” date at the top of this page. Where legally required, we may provide additional notice regarding material changes. If you enter into a separate agreement with Plotted Passage for travel-advising services, that agreement may contain additional or different terms that govern those services.

29. Governing Law

 

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except to the extent applicable law requires otherwise.

 

Any dispute that may lawfully be subject to an exclusive forum shall be brought in the appropriate state or federal courts located in Miami-Dade County, Florida.

Nothing in this section limits or deprives a consumer of any non-waivable rights available under applicable law.
